I cannot imagine what Sterling went through all those years. This story is very disturbing and unfortunately this has happened in other cases. It is even more disturbing that the South Carolina police would not reopen the case when the new evidence was revealed. It seems as if they continued to try to cover up things such as the how he got the coin. Apparently they found a scape goat and no matter what the real evidence shows they will not admit that there were mistakes and/or a framing.

The fact that Mr. Spann had to have an heroic effort to be saved from state-sponsored murder is amazing. I can't help but think ill of of a state that thinks a woman (Susan Smith) who brutally murdered her children and invented a story about who did it, got by with a sentence far less than death.

It bothers me so deeply that in a country that prides itself as being a democracy that innocent people can have their lives STOLEN from them by individuals who are so busy protecting their egos and names that they blatantly refuse to admit they are wrong. Believe me, my heart goes out to all the victims in this case, but I am so astounded at how fast people are to condemn a person because of their race, ethinicity, or socio-economic status.

People have to realize that it could be one of their family members or themselves who could be placed in a situation such as this, and when this occurs, they want you to be emphathetic to their cause. I cannot say if Mr. Spann committed the crimes that he has been accused and convicted of because I was not there, but I am certain we all have heard of situations where evidence has been planted or handled improperly which completely taints the entire judicial process.

As a society, we have to realize that our judicial system has a history of sending innocent people to prison and fabricating information. When this happens, no one wins because we still have those who are suppose to "protect and serve" that are continuously looking for a way to make a name for themselves while taking the life and livelihood of another. Please do not think I am going off into a frenzy about corrupt law enforcement because we have law enforcement officials who do excellent jobs in the most ethical manner on a daily basis, but we must realize that mistakes occur quite frequently and be able to admit when we are wrong.

Not particularly for this case, but our system
focuses more time and money on the "criminal" and not the "victim or victim's family." Our technology

I too am outraged and saddend by the monumental efforts it took to get justice in this case. When the offer was placed on the table for Mr. Spann to plead guilty with the hopes of being paroled, I believe the prosecuting officials knew from the beginning that they were not going to go through with this. It is amazing how "out of the blue" it was a mistake on one officials part that he could not be granted parole. I would ask those who were involved in this unethical and cruel lie, how could you live with yourselves while another human being suffered because of your cowardness? In a case like this where Mr. Spann was blatantly railroaded, those individuals who were involved in robbing this man of his life fail to realize that they have to answer to a Heavenly Father who sits high and looks low, and in conclusion they WILL have to reap what they have sown.

May God continue to bless the true victims in this case, the women who were murdered, their families, and Mr. Spann and his family.

It's very sad. In the end, Sterling had no choice but to plead guilty to save himself from the death penalty. I am a white woman, but I too see this as a clear case of racism.

In Canada our justice system makes stupid mistakes too, but at least they apologize later when the truth comes to light and give the wrongly accused a few million for their pain and suffering in jail.

It was obvious to me from the beginning that Sterling was not a serial killer because he had a soft heart towards women and was not the type to torture, rape and kill elderly females.

Some justice was served when a rich white couple stepped forward to fight for his freedom.

I do not believe the police planted evidence. As Sterling mowed the victim's lawn one would expect his fingerprints to be found. Perhaps he handed her a recipe from the mailbox? In fact, I would be surprised if none were found anywhere. If he is innocent, then I would not expect them to be found in her bedroom, and none were found there.

This man was a teenager at the time of the crime. It is unfathomable to me that officers would think he had the state of mind to get rid of the plethora of other fingerprints, much less hairs and fibers that should have been found during a violent rape and murder.

One drop of blood, that may or may not be Sterlings. What do they think? He commits a VIOLENT crime and cuts himself as he leaves the house? No drops were found inside the house. Maybe a first responder got a nosebleed. There are other explanations because it was only one drop and it was found outside the residence. It doesn't make sense.

As an African American, there should be hairs and fibers belonging to that race in the rooms where the violence occurred (at a minimum). None were found and that says something. We all leave behind hairs and fibers, that is a fact. Do they think he had the presence of mind to vacuum the place up? Where are the other hairs!

The lack of evidence in this case is astounding.

As a retired law enforcement officer, I want to say that felony cases are typically conducted in a thorough and methodical manner. No one wants an innocent person to go to jail, no one. I am dreadfully sorry for Sterling and the challenges he has had to face over the last three decades as he was convicted on flimsy evidence and supposition.

We have the best system of justice in the world, but it is not perfect. I believe he took the plea because he was terrified to put his fate and his very life, in the hands of 12 people. Considering what happened last time, how can you blame him?

Hmm. Last telling detail that I recall in this story is the poor Mr. Sterling pled GUILTY to the crime of murder. NBC just gave a loud voice to a confessed rapist and murderer of the elderly. I live in Clover, 2 yrs now. This is the first time I've heard about this story. I'm outraged. Every week I look at the "police blotter" in our local newspaper and usually the worst crime is public drunkeness. Now, I'm afraid and will make sure my doors are locked because honestly I don't trust that the law enforcement truely have any idea what to do with a real criminal. It's not like they are so busy around here with other crimes. Why couldn't they just do this investigation the right way?

Former death row inmate Spann wins parole, plans move to Conn.

COLUMBIA, S.C. --Former death row inmate Sterling Spann plans to move to Connecticut after winning parole Wednesday when the Probation, Parole and Pardon Services board voted 5-1 to release him.

Spann, 43, had spent 17 years on death row before he won a new trial on the charges involving the 1981 death of Melva Niell, 81, of Clover.

He was sentenced to 20 years to life in prison after entering a plea in 2002 that did not admit guilt, but conceded there was enough evidence that a jury might convict him.

The parole board voted against releasing him unanimously in 2004 and on a 3-3 vote in 2005.

Spann plans to move to Connecticut, where his attorney Lionel S. Lofton said a job is waiting for him. A couple from Monroe, Conn., saw Spann's story on NBC's "Dateline" several years ago and have become his benefactors, Lofton said.

The couple has no connection to Spann or to South Carolina. They own a string of tire stores across the country and "have adopted Sterling and his entire family," Lofton said.

"They have been working very hard to help Sterling and see that he's got good legal representation and make sure that he had a place to live and a job to go to," Lofton said.

The outpouring of support was unprecedented in Lofton's 30 years of practicing law. "It's really heartwarming to see that there are people like that in this country," he said.

Spann is currently at the Broad River Correctional Institution. Because his release to Connecticut must be approved by both that state and South Carolina, it could take up to 45 days before Spann is freed, said Pete O'Boyle, spokesman for Probation, Parole and Pardon Services.

Prosecutor Tommy Pope promised in Spann's plea deal to take no position on parole other than a letter stating Spann should serve the entire sentence. He did not immediately return calls from The Associated Press.

Lofton said Spann's good behavior while he was out on bond in 2002 might have helped his case for parole this time around.

"He had a track record for them to see that he hadn't done anything wrong" while out on parole, Lofton said. "Sterling's record since he's been back in prison has been exemplary."

A very uncharacteristic story by Dateline. I assumed they would have something to show that Spann was not guilty. Instead, there was more evidence. What did the guy do, just drive by the woman's house and say "hey, I need to go touch her window". No one offered any explanation as to how his fingerprint got on her window. I didn't see anything to show that all three murders were related- If I were a family member of the woman who was murdered, I would feel angry at Dateline for their pro Spann slant on the story!!

He did not plead guilty. Did the few of you who are claiming this not hear them clearly say that he accepted a plea bargain that DID NOT include an admission of guilt?? That was one of the main reasons why he accepted that particular plea bargain.

Someone also posted a news article stating the same information when he was released on parole a year ago.

I like how NBC screens these posts! And all the posts are coming up pro-murderer and supporting their ridicilous story...imagine that! He was convicted TWICE. He pled GUILTY! And if he isn't guilty he has the worst luck of all time! He just happened to know both victims. He just happened to have personal items from both victims on him and even if you dismiss the tie pin he still had the other woman's gold coin on him and that fact isn't disputed. His finger prints just happened to be on papers at the scene of the crime as well on a window frame INSIDE the house(a person who mows someone's lawn doesn't leave finger prints on the INSIDE of a person's bedroom window!). Both the homeless and imbalanced red-headed man "Cool Breeze" and the psychopathic murder just happened to change their stories multiple times! DNA EVIDENCE, from one of the victims' vaginas, JUST HAPPENED TO EXCLUDE BOTH OF THE OTHER SUSPECTS BUT COULD NOT EXCLUDE HIM!!! There just happened to be a spot of blood outside the window where the murder took place that did not match the victim or the other 2 suspects but just happened to MATCH his! And afterall he just plead guilty because he was so upset about his sister's death..WHAT? Innocent men do not plead guilty because their sister dies! Way to go NBC! But here are the facts that will not be disputed...he is a twice convicted felon, he pled guilty, and he is a murderer!
Bash the south all you want and run you liberal anti-death penalty mouths all you want but these things will still be true and as far as him bringing a lawsuit against the state...HE PLED GUILTY! It would be awfully hard to win a lawsuit against a state after pleading guilty to the murder that they charged you with.

A 20 year old man is now serving 30 years for something he was wrongfully convicted of because of Tommy Pope and York County.

NO SP! He stood up in court and said I withdrawal my plea of not-guilty and enter a plea of guilty. The deal only said he would not have to public admit to it other than when he entered the plea. That is just like pleading no-contest. No-contest goes down as a guilty plea!

People need to be clear about Sterling's guilty plea... what it was and why he made it.

Why? 1)He was afraid he would get the death penalty and be executed like a buddy of his had just been.
2)He lost faith in the judicial system (who can blame him?!)
3)His sister,tired after a shift, got killed while running a red light. This loss/grief demoralized him.

What was his plea? I quote

"He was sentenced to 20 years to life in prison after entering a plea in 2002 that did not admit guilt, but conceded there was enough evidence that a jury might convict him."

To those who still think he's guilty... the verdict by the jury here is like 95 to 5... plus there's the Supreme Court's almost unprecedented ruling, so you'd better go over the evidence/lack of same with an UNBIASED mind.

I guess those who think he's guilty didn't hear what the Alabama state prosecutor said?

Sterling's blood was NOT found in the house. The killer did NOT enter through the window. Sterling had worked for the woman, including on the windows, just a month before. The blood drop on the step was Type O. This proves nothing as this is the most common blood type.

Also, there's no evidence he had the tie pin on him. It was NOT listed as one of the items on him.

Etc, etc. Too many other points to mention!

Common sense alone tells us he didn't do it. Remember what the FBI profilers said about sadistic serial killers.

York County is known for their wrongful convictions. This has happened also to Berry Bolin. The investigation was nothing close to professional. The tactics that York County used were unreal. They didn't look at anything in depth. Tommy Pope, the prosecuter on the case, was more interested in closing the case no matter if they had the right person or not, rather than taking the proper steps in the investigation to discover exactly what truly happened. Berry was convicted of a crime that York County admitted that they could not prove. This seems to have became a common trait in the judicial system of York County. It's real hard to have ANY faith in the judicial system when accounts keep cropping up about people being wrongly convicted, being cleared by DNA, finding sloppy police/prosecutorial work, denying they ever make mistakes, denying new trials when new evidence comes up, etc. The stories of the men in Ada, OK. that Grisham is making more notable, and the court system adopting an "guilty til proven innocent" and "conviction at all cost" mentality is enough to make me sick. It is horrible that these innocent men should face time behind bars/on death row for crimes they didn't commit. Thank God for the TRUE detectives that actually have integrity and work for sometimes YEARS to clear people- also for the various Innocence Projects.

I have been reading all of the comments on racism concerning this case. When I was a young white girl in Charlotte, NC during the riots and black and white violence, my parents moved me to Clover.

Clover when I was there was a nice friendly southern town without major crime problems or racist problems. So this was extremely out of the ordinary and a rare cicumstance.

I can completly understand what Spann went through. I know first hand how bad the are in SC courts. I also pled no contest to a charge that i was not guilty of under presser from Tommy Popes office If I did not plea they threaten me with 30 yrs. My case was a civil case, and dismissed by the prosecutor. 1 year later I was arresseted in NC and back to SC carolina I was taken once again to York County. with no evidence they took a civil case that had never been to civil court turned it to crimmial and gave me 5 yrs. I was just released from SCDC may 1st of this year. My case is pending still in federal court after 1 year in a writ of Habeas corpus. I filled pro-say. I am home now, My heart goes to Spann we knew him in prison trust me when I tell you he and I are not the only ones in or out that the State if SC has grossly neglected the UNITED STATES CONSTITUTION in south carolina courts it is wide spreed through the dirty south known as south carolina.

I'm a bit confused. Did the tissue slide evidence from the autopsy of the first victim in which Sterling was a potential donor exclude Hullet? It seems that it did. That's who they made it seem like the whole show was the real killer. So if the semen excludes him then who did it? It seems like the same person committed all three murders but Sterling was locked up at the time of the third; therefore he's innocent of that one at least. The story was very anticlimatic; when Sterling took the Alford plea it was really disappointing and made me less sure of his innocence. I can see why he did it though even if he is innocent. Gambling with your life is a big gamble and he'd already been convicted once. Still it was really disappointing. I thought we were going to definitively find out who the real killer was but instead it was unclear because the semen evidence seems to exlude Hullet.

Wow did this poor man go through the ringer in the justice, I mean unjust system. Kaley, lie detectors are not infallible. Innocent people can flunk them, and guilty people can pass them. They measure bodily bp etc. but any scared, excitable, emotional, person can flunk them--not only that, but police are allowed to LIE about the results, about evidence, and witnesses--all hoping to intimidate a confession out of person. I take NO stock in polygraphs, false or negative.

That said, I DO believe Spann is innocent and hope he is well compensated for the hell he went through, due to the ineptness and dishonesty of the system.

I have always been a proponent of the death penalty as a deterrant. This case, along with some other well publicized DNA exonerations has me re-thinking my conviction.

I'm sure that, even in the south, most law enforcment officials "protect and serve" with the utmost professionalism. I am truly saddened by the unfortunate turn of events that surround Mr. Spann's
debacle.

This dateline edition on Sterling Spann has broke my heart for the man. His life has been destroyed by the lies, injustice and the failure of the law to investigate a crime properly. This is not the first time the arrogance of the law has sent innocent men to jail and death row, and surely, it will not be the last. I came to north america 4 years ago from africa and this story has oppened my eyes to one of the things that could happen to a black just for being black. who knows how many have been executed in this manner.

People have been freed just by their convincing alibi Spann was innocent from the start but the law just chose to make a name against all convincing evidence that span was innocent: why waste a human life just like that; what is the hope of innocent people.

As intriguing the story was, the end was even more enigmatic. An amazing telecast which leaves you in the end wondering whether the defendant was really guilty or was it the racial bias that made Mr. Spann suffer and spend his youth in a cell for 23 hours a day for 17 years. I firmly believe that even though the justice might not have been served in this mortal world, the soul of the real culprit will have to answer in the court of God.

Are any of you listening beyond the bias of MSMBC? Do you really believe he is innocent? I bet you all believe OJ is also innocent. Just forget the facts. Of course all police are liars. Just waiting to frame a black man.

I Believe after watching the show that Sterling Spann Is innocent. You Have to Remember the Da And The Police will never let the truth be known due to the fact of if it is found that the police lied it would put in question all the other cases that these officers and D.A.s won would be put under the microscope and all these people would loose all their retirements and benifits and possibly face jail time so they will never tell the truth about this case. Some people hear about a case like this and conveniently use it as "proof" that all people from the South are prejudice or racist. I resent that. I think the people who were directly involved in prosecuting Sterling are the ones who are prejudicial or racist. "Prejudice: Any preconceived opinion." This case should have been declared a mistrial due to the contamination of the scene and the evidence. I am ashamed of my native state for what was obviously a racial railroading of an innocent man. Even the deceit they used to get him to plead guilty was a crime.

You mean to tell me the whole crime scene was compromised and the envelopes weren't what a joke. None of that evidence should be considered since the scene was so botched by police and allowing the family to clean up the house before the investigation was done.
