Justice for Barbara

The email arrived on a Sunday morning, at 4:50 a.m.

I'm writing to you about a 25-year-old cold case from 1981 in which a woman named Barbara L. Winn was shot in the chest with a .38 Special after a violent fight.

A woman named Patty Bruce was writing about her sister-in-law, Barbara Winn, whose death in 1981 had been ruled a suicide.

The e-mail claimed Barbara had not killed herself, but that Barbara was murdered by her ex-boyfriend, Aaron "Bubbie" Foster. The e-mail revealed that Foster was currently a free man, working for the St. Paul Police Department.

We receive many e-mails alleging miscarriages of justice, but there was something about this one.

There was a sense of desperation and frustration, the sense that over the years there were cries for justice, but they had fallen on deaf ears. More than anything, it seemed this family simply wanted someone to listen.

The e-mail plea ended with this:

We want justice! We are convinced that both personal politics and a web of corruption have played a role in the miscarriage of justice concerning Barbara.
We wanted to hear their whole story, from the beginning.

So we set up a camera in a quiet place in Patty's house and left it there for a couple of months. We invited anyone in Barbara's family to speak privately to the camera whenever they wanted, about anything they wished. I spent dozens of hours screening those tapes, hearing those private words. To be sure, the raw emotion is heart wrenching: anger, frustration, bitterness.

Watch Barbara Winn's son, Tyronne, sing a song for his mother.

My own research began with the day of Barbara's death. Her kids recalled that nightmarish May night back in 1981 as though it was yesterday. They all remember hearing their mother and her boyfriend, "Bubbie" Foster, arguing. There was the sound of glass breaking, and then a gunshot. The three of them ran to her room, they said, and saw Foster running out.

Tyronne, who was just 12 years old then, remembers his mother's last words were "Oh Bubbie, that hurt."

I would learn that Foster told police that Barbara had shot herself, and that her dying declaration had been for him to "get rid of the gun." That's why, he says, he took the gun from the house, drove away in Barbara's car, and tossed it out the window. Authorities believed Foster, and ruled Barbara had taken her own life.

Barbara's kids say he was lying, that he murdered their mother and covered it up. They also claim it's Foster's connection to his longtime friend, St. Paul's former police chief Bill Finney, that somehow sheltered Foster from punishment. Serious allegations, to be sure, and ones that Bill Finney adamantly denies.

Getting at the heart of this story was a tall order. It's an old crime, Foster has repeatedly denied he killed Barbara, and he's already been looked at as a suspect.

As we looked into the story, it turned out the authorities in Minnesota had decided to take a second look at the case, too. The current sheriff had asked one of his veteran investigators, Bill Snyder, to reinvestigate it. Not knowing where his investigation would lead, I asked if we could follow Snyder as he looked for new clues and new witnesses. They agreed.

Over many weeks, using a small, handheld camera, I shadowed Snyder as he dug for answers.

But this story became more than an investigation into a nearly 30-year-old cold case.

Watching those private tapes recorded in Patty's house, what struck me the most was the incredible love and respect Barbara Winn's family and friends still have her, all these years later. They are the ones who really tell this story.

A story that began with an email to a stranger.

Thank you for pressing forward for the Winn Family.  Patty and other members have been seeking justice for a very long time.

Myspace friend of Patty,
Shawnda
I don't know which is the bigger story; Barbara's death and the injustice that followed or the amazing story of children loving their Mom so much to fight for justice. What an amazing woman Barbara must have been to have instilled such love and honor in her children.
I found Barbara's story online and just heard that this network took interest enough to make the edge needed to get the attention of investigators.

It's appalling that anything of this nature should take the course that it did, when reading the facts stated above. It does look as though no one listened to her three children who witnessed what happened.

And for so many years to pass before someone finally took interest into a true investigation.  I'm glad Barbara's family never gave up the fight for her, and that maybe now will come some peace, even though 30 years is a long time coming.   I praise the efforts of Patty, how heartbreaking to go through what they have been, and her strength to carry on, getting the Justice that Barbara should have had long ago.  Thank you for bringing taking the interest to find the truth no matter how many years ago this still brings such pain to her family.
I read your blog about Barbara Winn on My Space.  Found it compelling as well as interesting.  Good storyq
Amazing....that a case such as this was pushed under the rug for SO LONG....I am so happy that Barbara's family never stopped fighting for the Justice that is so much deserved....to think this man has walked our streets everyday, with no recourse of what took place so many years ago.  How could one go on knowing what they are responsible for!!  I pray for her Justice that is so much derserved....for her to once and for all be able to rest in peace, and for her family and children to share a piece of that peace of mind as well!!  In my prayers always!!  Kristen
Thank You for airing this Cold Case, involving Police, Coverup, lost evidence, Its Bizzare that the Grand Jury found Guilt, yet Aaron Foster is allowed to work for the City of St. Paul, in the Police Impound Lot, http://justiceforbarbara.com great site

It's said what has been done in darkness always comes to light, sometimes it takes a while but it will come. I've long known about Barbara Winn from MySpace and I'd hope there finally comes that light and justice for her loving family.
St Paul and Minneapolis Minnesota! The best thing that could ever happen is if someone took a great big broom and swept both police departments out from the front door to the back door, from tower to dungeon and took all of the garbage and put it on a slow boat to the moon. Unfortunately, considering the current cop culture nationwide, that fix wouldn't last very long. Thank God for the investigators and their media resources that can shine even a little light into some of these dark, dark corners.
absolutly a GREAT story tonight!!

as someone who is also fighting for justice, i'm really hanging on to what the one investigator said about never giving up.  altho i dont think we will ever see the inside of a courtroom for my daughter's death- i will continue to think of Barbara as i keep fighting.

i would have not known about Barbara if it werent for myspace.   Patty & family have done a nothing less than amazing job on & off myspace!

much love

MY NAME IS LENORA STONE AND AS I WATCHED THE SHOW TONIGHT ABOUT BARBARA, I COULD ONLY THINK OF THE PAIN THAT YOUR FAMILY HAS BEEN THROUGH - LET ME SAY THAT MY PRAYERS AND THOUGHTS ARE WITH YOU TIL THE END IN THIS MATTER AND HOPE THAT SOMEWAY THAT YOU WILL FIND PEACE AND CLOSURE FOR YOU AND YOUR WHOLE FAMILY - I AM GOING THROUGH THE SAME THING MYSELF AS MY MOTHER WAS MURDERED IN FRONT ME IN 1971 (GOOGLE "SYKORA MURDER") WE HAVE BEEN WAITING TO GO TO TRIAL FOR 3 YEARS NOW... I WOULD LOVE TO TALK TO YOU ABOUT LENORA.STONE@YAHOO.COM
WHAT IS THE MYSPACE NAME FOR THIS? THANKS
I would like to thank the entire team for helping the late Barbara Winn's family to get justice.  I am really confused with how people can commit a crime, and live with this on their minds for years.

Foster and Aaron (the police) were friends and because of Aaron's closeness with the accused and even for employing him, I think that Aaron should face some trial too, because he knew what was going on. I cannot understand how one can hide their friends from justice, I could not do it.

I realiae that Foster would go on Trial in July 2008 and I sincerely hope that he would get life without mercy, and that Dateline would do a follow up for us to know how this case would end.  I would like the Ex-police to go on trial too, and that he is given time in jail for exploying such a character in the field of law and to entrust him with a gun.
Mr. Slepian,
Why doesn't Dateline's Mike Tiabbi do a story entitled "Justice for Jill and Kathleen" (see attached Disposable People)? Mike Tiabbi made a deal with the LAPD in 1978 to film my staged "arrest" for these two murders as a "Hillside Strangler" suspect and broadcast it nationally without waiting to see if the LAPD would charge me with these murders or not. After 48 hours of questioning and investigation, I was released and received a public apology from Chief Gates who hoped that "no irreparable harm would come to Mr.Jones because of the Media who were leading this case."
The LAPD says the murders of Jill Barcomb and Kathleen Robinson in 1978 have never been solved and their records "were lost in the earthquake"?
Mike Tiabbi used "Disposable People" like me to further his career by getting on TV with sensational, false accusations and then moving on, forgetting his victims both dead and alive. That is why I have been trying to get a NO-NAME LAW passed that would prohibit the Police from releasing a suspect's identity to the media or public until such time the "suspect" is legally charged with a crime. This fair law is needed to protect innocent people from the "irreparable harm" that ambitious, unethical reporters, such as Mike Tiabbi, can do to their lives and the lives of their loved ones.
Birds of a feather, flock together.

My heart goes out to the Winn family especially the children. I was really touched by this case. It was very upsetting and disturbing to see how the coldblood murderer was working for st paul police station and got away with this for sooo many yrs. He is clearly guilty. Stories like this makes me realize why i got out of a verbal/abusive relationship. It wasn't easy and I can clearly relate to this story.  Mr. Foster killed Barbara Winn. The evidence are the children. THey saw what happened. He is guilty and will be found guilty. I will definitely be keeping the winn family in my prayers this july 2008. There will be justice for barbara and her family. I hope and pray that other families similar to Barbara's case fight for justice b/c I literally had to move out of the state to get away of what could've been my potential murderer.

The show tonight was presented in such a way that it brought to light so much more about the case.  I can't help but feel the pain of the Winn family.  I also feel their determination.  I cannot wait until you update tonights show with the announcement of Foster being found guilty.
I was drawn to Barbara's story.  My heart went out for her children.  I too lost my mother when I was 9 years old.  She was shot while my father and her boyfriend fought with a gun.  The gun went off and she was shot in the right temple.  But, to loose your mother at that young age is tramatic.  My father ran away after the shooting and to date no one was charged with the murder/accidental shooting. My mother left four children, myself and three brothers.

Since then, my understanding is that my father has passed away and for the boyfriend I actually saw some years ago.  When he saw me all he could do is stare and she you look just like "Beth". But knowing was asked or said about the night of Oct 1, 1960.  My mother was 28 years old.
I feel like she was just a statistic of a domestic altercation.
This cold case was so compelling and infuriating.I can't help but feel that if Aaron "Bubbie" Foster hadn't had a friend in high places he would have been prosecuted long ago. What a corrupt department Chief of Police, Bill Finney must have run if this friendship is any indication. I hope this story ruins the memory of any career he had. The audacity of hiring this man to work in the department is unreal. Why should he get away, unscathed, with the injustice he has done to the Winn family.

I so hope for this family to get the justice they deserve. Thank God for the sister in law who is working so hard to get to the truth. Please pray that the courts see the truth and that this man, Aaron Foster, who has walked around a free man to long, gets what he deserves...........a long stay in prison.

Wow, what a powerful story. I really pray that Barbara's children will get justice. In addition to the murder case, will that Ex police chief be investigated for cover-ups of his woman abusing murderer friend's crimes? It just seems like too many chrges being dropped for a man who has a pattern of beating women.
This was the power that this case needed,For all of us who are in a fight for justice we have never had any power and its what holds our case up so much so some will never find an end,Thank you for helping Barbara she was someone and she needs justice! So glad you all saw and helped.....
one other thing regarding police chief finney and the implication that he helps out his friends - - approximately 6 years ago his son got in serious legal trouble and all charges were dropped - - as a life-long resident of St. Paul, i have long been suspicious of him - - i have heard of other questionable actions regarding finneybd
I first heard of this story when Patty requested me on Myspace. I felt for this family, cried for them, and prayed that someday they will finally have justice for Barbara.  The segment was wonderful. It showed the pain that the family is still living through and it showed their determination to see this monster pay for what he did.

Domestic Violence is a HUGE issue, as I have been faced with a tragedy in my own family.  My Aunt and her three children were brutally murdered on this past Thanksgiving at a park in Laytonsville, Maryland. My Aunt fought very hard for protection from her ex-husband and father of her children and her pleas were ignored by the system.  She asked them twice to take away his gun because she feared for her life and they allowed him to keep it.  It was with that gun, that he shot Gail Pumphrey age 43, David Brockdorff, age 12, Megan Brockdorff, age 10, and Brandon Brockdorff, age 7, before killing himself. Domestic Violence is an issue that is all too familar to many familes and has devastated mine.
I was so impressed with the story you did with the Winn family. I'm fighting for my sister and will until my last breath. Her accused killer is the father of her children and has not been prosecuted because it's supposedly a circumstancial case. Please continue to be the voice of our loved ones who have been silenced. It is unacceptable that their lives have been condensed to pieces of paper in a box on a shelf gathering dust

LOVE AND RESPECT,

Bubby is a good friend of mine he is like family i dont believe he did this, I dont see a nice kind man doing that. I love him with all my heart and soul and i believe he will walk free from all of this because there is no way god will send him prison. Oh and Date Line You just lost alot viewers. the whole time when i watched the show last night i couldnt help but notice that the son never cryed just had A smerk on his drugy face i only seen her daughter cry...."Bubby you have some one out there on your side" i will never believe he did this. My Heart is With You..
these are some very tragic cases where investigators but up on dead ends in helping to bring justice to the families of victims. We should never give up the fight for justice though it takes forever sometimes.
Awesome job Daniel.  Patty Bruce and her family have inspired all of us to seek the justice our family members deserve.  Thank you for putting a spotlight on this case.  Very well put together. Patty, good job.
That was the BEST job I've EVER seen done of a televised program on any case. Standing ovation. I wanted to cry at the beginning and the end. And Snyder saying never stop fighting is burned into my character.
Using the family's experience in such a personal way, highlighting not just the fight but also the paralysis of the trauma to them was really one step beyond anything I have seen before.
Thank you for what you and those working with you have accomplished - And may that justice for Barbara come quickly now... or at least

surely.

Deon
thank you for doing this story... i watched and i was broken-hearted, just as i was when i first read about my sister, barbara winn on myspace... like others my heart was only broken more to learn of the absolute injustice that took place time and time again after her death and the investigation that should have but did not happen... BLATANT INJUSTICE AND INDIFFERENCE

i was so happy... and hopeful to see the story... it should have happened many many years ago... thank you for doing so now
Thank you so much for this story presented about Barbara Winn's murder and the long anguish that this wonderful family has endured.  It is so wrong that this man has walked away from this murder.I think that the information you have presented so completely will assist bringing this situation to light and hopefully the many others out there...I am sure this is not the only cover up for a friend that has ever happened.  Thank you for the excellent presentation.  Let's hope he gets what he already should already have....thanks again for your work.
NBC Dateline. you did a wonderful thing here, inspiring to know that there are some people here -for the people, and reading the above comments shows more...(with the exception of one)

I don't know how anyone could deny the evidence as it is shown, and for so many years, and yes that Police Chief needs a full investigation into all of his actions over the years, and to think he could hire this murdering abusive man and now it makes you wonder how all that evidence disappeared...  conveniently.

All states need to be strong against domestic violence, and the offenders must be shown no mercy, put them away because they only get worse.   They don't stop.   Anger management, Domestic Violence classes...yeh, right, no. They need to be locked up and then given those classes.  inside prison.  away from hurting one more person.

All prayers and much love to the entire Winn family
I love the song from Barbara's son, that was from his heart...  and shows men don't have to show tears to show their hurt and the love they have in their hearts.   Hallelujah...
Thank you so much for doing Barbara's story. My sister died under questionable circumstances. I wanted to have it investigated further. Her children wanted to just "let it a lone". We probably will never know. After watching this I see that I could've done something more for her.
Thank you for showing a cold story that wasn't about someone "rich and famous".
Fantastic story! Thank you for airing this for us that have not heard of it, but were encouraged to not give up.
I've followed this case through myspace and watched last Friday - thank you for bringing this to a much wider public - it gave me hope that maybe someday the shooting and burning of my own daughter Anke will get solved.

To Dan, Mike and everyone at Dateline

I just want to say thank you for everything you have done for the Winn family. Your belief in what is wrong here shows that there are still those out there who know right from wrong.

To Bill Snyder: You are an amazing investigator and a great man, thank you for what you have done here.

To Patty, Barbara's children and siblings and all the other family members, what a job you have done.

Aaron Foster is on the fast track to paying for his evil ways.

And to anyone who is out there and thinking that their family member will not get justice, just believe and never give up!

The nation has seen the evil of Foster and the coverup of Bill Finney now.

I wanted to thank you for the special you did on the  Barbara Winn family.  I have had her as a friend on myspace for a while now, and though I have never met the family, feel connected to their pain.

My friend was murdered in Pittsburgh about 15 years ago by her boyfriend and he is walking free.  After being allowed to plead the fifth ammendment, Pgh felt there was not enough evidence to move forward.

This is so unsettling as there had been previous abuse and warning signs as in Barbaras case.

I am so happy for this family that justice will be served.  It was heartwarming to see her children and family still loving her so much.

I would love the opportunity to get the same justice for my Debbie, and anyone who is a cold case due to faulty and lazy systems.

You have done a great justice to so many---even if it was just to give them hope.

Bless you and everyone affiliated with this case.
Thank You for giving Barbara's Family a voice...
They have been in Pain long enough. Now thanks to you and your understanding they can start the healing they so need. A Foster is a killer and now Justice will be served. Keep doing the wonderful work you are doing in giving people like the Winn family hope for justice, peace and healing.

Barbara's story is finally out and the truth is known now. YOU helped make Barbara's voice be heard. I am so glad that her children and the rest of the family get the justice they so deserve and maybe now Barbara can rest in peace! May God bless you !

I made my daughters and friend sit with me to watch it. I cried from the begining to end. Very powerful, and great work. I think finally there will be justice for Barbara. Thank you for the documentary, and thank you to help such a wonderful family God bless you.Y

I FOUND THIS STORY TO BE SO TOUCHING, AND SO FULL OF LOVE! BARBARA MUST OF BEEN A WOMAN FULL OF LOVE AND KINDNESS, I HAVE A DEDICATED TO THE MISSING PAGE ON MY SPACE SO I HAVE BEEN FOLLOWING THIS, THANK YOU FOR TAKING THE TIME TO LISTEN TO HER FAMILY IT GIVES HOPE TO OTHER FAMILY'S OUT THERE THAT HAVE MISSING OR UNANSWERED QUESTIONS ON WHAT REALLY HAPPENED TO THE LOVED ONE'S! GREAT STORY!
I saved the episode in my DVR & just watched it today.

I have so many comments; however I find this burns my brain the most!

I just can't believe that every time that MONSTER Foster did all those terrible things to the women he supposedly cared for, there was never a RED FLAG that went off in the police data system!!!  You know, like Repeat Offender, Repeat Abuser, Repeat Protective Order, etc.  C’mon, it’s not rocket science!

It really makes you wonder the level of cover-ups & threats that went on in that police department!  So with that said, I guess death ears & blind eyes where prevalent when it came to MONSTER Foster.

We have the technology & the know-how to develop such devises, so if there’s not such a system…what the heck is taking so long!?  And this RED FLAG warning should be known to the highest of police, not just the stations captain, etc.  There should be more than just one cook in this kitchen!

It’s a shame knowing that there are crooked “cops” out there that tarnish the badge & keep a dark cloud hovering over police departments saturated with dishonor!

Lastly, it would also be commendable that for the other women whose cases where neglected & brushed-off, be offered & served with justice as well.

God Bless you all & may you continue to receive & feel at piece!
Thank you Dateline for airing this.  How sad for this family losing a loved one in such a tragic manner BUT to have the St. Paul Police cover up for Finney!  How much power have was given to these crooked cops?  The tax payers should be in an uproar over his behavior and anyone who is linked to him.  This story would periodically show up in the newspaper but everyone knows, you can't touch a cop. Also, Finney has a son that has been on the paid leave for 2 years?  What a vacation and once again, this is tax payers dollars.  Why does Finney have so much power?
To the Winn Family, my heart goes out to all of you.
Having been there and knowing the details about what happened in this particular situation, this is a SAD state of affairs that this INJUSTICE has gone on this many years without resolve. I pray that my 2nd family (Randy, Tammy and Tyrone) finally have closure. Your Brother, Stephen
I truly thank dateline for airing this family’s story.  As a survivor of domestic violence I feel the pain of this family.  If I had passed away when my husband tried to kill me, I would hope that my son and family would have loved me as much as Barbara's kids and family loved and still love her.

I pray that justice is given to Barbara and her family because nobody should have to die in the way that she did.  It doesn’t take a rocket scientist to look at this case and know that Barbara would have never taken her own life.

Blessings to the family
Awesome story and  to the family... I'm sure your mother is looking down  upon you from the heavens above and admiring the wonderful children that she has, for never giving up seeking justice for her..
May Justice Prevail!
Thank you Dateline for bringing Barbara's story to light. I learned about the case on my space. Being a domestic violence advocate, I see many victims who become frustrated with the system. I hope that more families will see justice for their loved ones. The story brought to light how the families and especially the children are affected by domestic violence murders. It does sadden me that people can still make ugly comments about the family members. Have they not been through enough? Thank you for bringing awareness to domestic violence.
I didn't know Barbar Winn, but I feel like I knew her because I see her everytime I log on to my MySpace page and there she is.  I hope she see's that everyone is trying to seek justice for her so she can finally rest in peace.
Felicia
OMG she was BEAUTIFUL, as are her children. It makes me so happy to know this story is out. I know she is looking down on her family, with love and  the biggest grin. The system may have failed her but her family did not!!!!
Great story and outcome, I wish it had been sooner. Listening to the story that night brought back alot of painful moments, it sounded like my sister's, Linda,  story, she was 29 with an 8 yr old son (not his)...
Aug 7, 1987, there was a fight, a gun shot, a boyfriend leaving the apartment and driving away and the "claim" that it was suicide...
Thank God he was too stupid (he put the gun upside down in the wrong hand and this is only 1 example) and didn't have friends in high places...
He is still serving his 33 year sentence and is due for release in 2013...
I hope this brings some peace to the family, 25+ years is a long time to have all those emotions inside of you....
You are truley a wonderful family, Barbara would be oh so proud of you all............
Thank you for bringing this to the public!  I watched and cried all the way through this documentary....they were sad tears and tears of joy for Barbara's family.  I couldn't begin to imagine the horror that her children must have experienced as they watched their mother lying there on her bedroom floor dying in front of them.  My heart went out to each of them....I wanted to reach out and hug all of them.  And knowing all these years that their mother’s killer was free and walking the streets and working in the police department.  Was it he who destroyed the evidence or was it his friend the police chief?  It makes me and others wonder ….injustice….you bet it was!  The police chief should go down too!  When I watched that and all the evidence of his friendship with Barbara's killer I knew there was a conspiracy and a cover-up in this case,  whether the authorities want to admit it or not.

I am so very impressed with the sister-in-law and her persistence in bringing this case to the public so justice can be served for that family!  This family needs to be able to put closure to their mother’s death and feel relieved that her killer will never kill another girlfriend or wife that he may have, because he clearly has an uncontrollable anger problem!

My only concern now is that this case should be moved to another city where there can be no influence on the jurors that clearly would be chosen from that community!
